There was probably no definition of digital rape before December 2012, and then it didn't even comes under the category of rape. But after the Nirbhaya case of Delhi, when rape was again defined, then digital rape was also included in this category. In fact, digital rape does not mean any digital sexual harassment. We all know that digital means one digit and the other means finger thumb or toe. When a person uses any part other than the reproductive organ of a woman or person, such as a finger or object for sexual activities, then it is called digital form of rape.

Although now rape or digital rape both come under the same law and in most of these cases IPC section 376 which deals with rape, 323 which deals with causing hurt and 506 which deals with criminal intimidation, and POCSO action can be taken under sections 5 and 6 of the Act.
Recently, a new digital rape case has come to light from Noida, where an 80-year-old man has been accused of digitally raping a 17-year-old minor girl. The name of this accused is Marris Rider, this person used to digitally rape a minor girl for 7 years and that girl lived in his house. The police has arrested the accused and further action is being taken in this matter.
